SECOND CHANCE PROMOTION
FROM THE ILLINOIS LOTTERY
- 1. PROMOTION PERIOD: THE PRICE IS RIGHT™ Second Chance Promotion from the Illinois Lottery (“Promotion”) begins at 12:00 AM Central Time (“CT”) on August 1, 2022 and ends at 11:59 PM CT on May 31, 2023 (the “Promotion Period”).
- 2. SPONSOR AND ADMINISTRATOR: For purposes of these Official Rules, “Illinois Lottery” shall mean the Illinois Department of the Lottery, which is acting through Camelot Illinois LLC in its capacity as private manager or its successor designated by the Illinois Lottery (“Sponsor”). The Promotion is administered by Scientific Games International, LLC. (“SG”) and its affiliate, MDI Entertainment, LLC (“MDI”) or a successor designated by Sponsor (collectively referred to as “Administrator”).
- 3. AGREEMENT TO THE OFFICIAL RULES: By participating in the Promotion, all players fully and unconditionally agree to and accept these Official Rules and the decisions of the Sponsor and Administrator as final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.
- 4. HOW TO ENTER: Players must enter the Promotion online during the Promotion Period either by going to the Illinois Lottery website (www.illinoislottery.com) and clicking on THE PRICE IS RIGHT™ Second-Chance Promotion link, which will take the player to the Administrator’s promotional page (https://illinois.secondchancebonuszone.com/thepriceisright) (“Promotion Page”), or by going directly to the Promotion Page. On the Promotion Page, players must (a) confirm they are entering from within the boundaries of the State of Illinois and are eighteen (18) years of age or older; (b) provide their complete name, a valid Illinois address, and a telephone number; and (c) provide the ticket number and entry number for a non-winning Illinois Lottery #7473 THE PRICE IS RIGHT™ ticket (“Eligible Game”). During the Promotion Period, players can enter a maximum of twenty-five (25) non-winning Eligible Game instant tickets per day. Each Eligible Game instant ticket will result in five (5) to twenty-five (25) entries, with a chance to win an additional five (5) to one hundred (100) bonus entries, into a drawing for the Trip Prize (defined below) depending on the Eligible Game ticket information entered. Entries are not valid for any other promotional offers. All entries shall be subject to verification by the Illinois Lottery. ENTRIES MUST BE RECORDED ONLINE WITHIN THE PROMOTIONAL PERIOD TO BE INCLUDED IN THE PROMOTION. Late entries will not be eligible. The Promotion computer, operated by the Administrator, shall be the official timekeeping device for the Promotion entries.
- 5. ODDS: The odds of winning for the Promotion are dependent upon the number of entries received for that drawing.
- 6. ELIGIBILITY: The Promotion is open to individuals who, at the time of entry, are at least 18 years of age, are legal residents of Illinois, hold a valid non-winning Eligible Game ticket on sale or open for redemption during the Promotion Period and enter from within the State of Illinois. Entries must be complete to be eligible.
In addition, the following persons are not eligible to enter this Promotion or claim a prize: (a) any member of the Lottery Control Board ( "Board"), any officer or any other person employed by the Board or the Illinois Lottery; (b) any employees of any TV station from which Illinois Lottery drawings originate who are directly involved in the production of drawing telecasts, including floor directors, camera operators, stage hands, character generator operators, air control technicians, announcers and performers for each telecast; (c) officers and employees of the Sponsor, and its owners; (d) officers and employees of the Administrator; (e) officers and employees of the Illinois Lottery’s advertising, public relations, and sales promotion agencies assigned to the Illinois Lottery account; (f) officers and employees of audit firms performing services for the Illinois Lottery; certain other contractors and agents of the Illinois Lottery; and (g) any spouse, child, or family member residing as a member of the same household in the principal place of residence of any person designated in (a) through (f). Any Illinois Lottery tickets mechanically reproduced, altered, mutilated, tampered with in any way, containing any printing or other errors, or not received through legitimate channels are null and void. This Promotion is void where prohibited by law. - 7. PRIZES AND THE VALUE OF THE PRIZES:
- A. Trip Prize
Eight (8) Trip Prizes: A four-day, three-night trip for the prizewinners (each, a “Prizewinner”) and one (1) guest to Las Vegas, NV to occur on or about fall of 2023 (“Trip Prize”). The Trip Prize shall include roundtrip coach airfare for up to two (2) people from any U.S. international airport to Harry Reid International Airport in Las Vegas, Nevada (inclusive of all associated security fees, taxes and surcharges), if air travel is required for the Prizewinner and guest; ground transfers between Harry Reid International Airport and the destination hotel and, if necessary, between MDI hosted events; one (1) double occupancy room accommodations (room and room tax only) at a 3-star or better hotel in Las Vegas, Nevada for three (3) nights; one thousand dollars ($1,000) spending money for the Prizewinner to be provided two (2) weeks prior to the scheduled trip departure date; admission to the COME ON DOWN Challenge Event (the “Challenge”) theater/venue for the Prizewinner and guest, and the Prizewinner, or duly authorized proxy, shall have one (1) chance to participate in the Challenge. The Prizewinner’s guest may sit with the Prizewinner but will not be eligible to participate in the Challenge unless the guest has been appointed as the Prizewinner’s proxy. The approximate retail value (“ARV”) of the Trip Prize is $7,500. - B. Challenge Prizes
Challenge Prizes: Prizewinners shall have one (1) chance to participate in the Challenge to compete for prizes (collectively, the “Challenge Prizes”). The potential size of the Challenge Prize shall be based upon the ROUND (defined under Section 8) in which the Prizewinner is participating. The Challenge Prizes in the ROUNDS range from $1,000 up to a chance to win $50,000,000 (“Grand Prize”). Prizes of $1,000,000 and above shall be paid in the form of an annuity over thirty (30) years. In the case of the Grand Prize finalist’s death, any remaining annuitized payments will continue to be made to the estate of the deceased. If elected by the Grand Prize finalist and upon Sponsor’s approval, lump-sum payments for Challenge Prizes of $1,000,000 and above shall be awarded. For example, the Grand Prize finalist may elect to receive a lump-sum, one-time payment of $36,000,000 in lieu of the $50,000,000 annuity.
The dates and times of the Promotion are subject to change and/or possible cancellation. The Prizewinner and guest(s) agree to comply with all applicable venue rules and policies in connection with the Trip Prize. Any comments made by a Prizewinner in a social media format containing material that is inappropriate, offensive, indecent, obscene, hateful, tortious, defamatory, slanderous, or libelous may disqualify the Prizewinner, at Administrator’s sole discretion. The Promotion Entities (defined below) will not be responsible for acts of God, acts of terrorism, civil disturbances, work stoppage, or any other natural disaster outside their control that may cause the cancellation or postponement of the Promotion. All other expenses and costs, not expressly listed above, including, but not limited to, federal, state, and local taxes, parking, mileage, insurance, gratuities, meals, baggage fees, alcoholic beverages, personal expenses such as telephone calls, valet service, laundry, incidentals and the like, revision or cancellation fees that may be charged by the hotel or other suppliers, and ground transportation are the Trip Prizewinner’s sole responsibility. All travel risks, insurance, loss, or damage due to Trip Prize acceptance or use are the sole responsibility of the Prizewinners. Neither the Promotion Entities nor their affiliates or subsidiaries will be responsible for any loss, liability, or damage arising out of a Prizewinner’s acceptance or use of a prize.
- A. Trip Prize
- 8. WINNER SELECTION:
Trip Prizewinners. Two (2) drawings will be held. The first drawing will select four (4) Prizewinners. Entries for the first drawing must be received by the deadline date of January 11, 2023 at 11:59 PM CT. The drawing will be held on or around January 13, 2023. The second drawing will select four (4) Prizewinners. Entries for the second drawing must be received by the deadline date of May 31, 2023 at 11:59 PM CT. The second drawing will be held on or around June 2, 2023. The Illinois Lottery reserves the right to draw additional alternate participants from the remaining pool of entries. A list of the alternate participants will be kept in the order in which they were drawn. In the event that one or more of the Prizewinners do not qualify, or it is determined that the ticket used for entry was obtained through any fraudulent or unlawful means, alternates will be selected from the list in the order by which they were chosen, as replacement Prizewinners.
Challenge Prizewinners. The Challenge will be conducted according to event and security procedures generated by SG and its third party underwriters. Final Challenge details (the “Challenge Details”) explaining how the Challenge will be conducted will be provided to the Sponsor no later than 60 days prior to the date of the Challenge.
Each Prizewinner (or an assigned proxy) shall participate as a contestant in the Challenge together with participants from other participating lottery jurisdictions (collectively, the “Contestants”). There will be three (3) rounds (each a “ROUND”) for the Challenge. Each ROUND will be played separately.- A. ROUND #1 PUNCH A BUNCH™: All Contestants (each a “PUNCH A BUNCH Contestant”) will participate in ROUND #1. ROUND #1 reduces the number of PUNCH A BUNCH Contestants down to ten (10) finalists (each a “BIG WHEEL SPIN Finalist”). The ten (10) BIG WHEEL SPIN Finalists will advance to ROUND #2. "The eliminated PUNCH A BUNCH Contestants may win a Challenge Prize between $1,000 and $5,000;
- B. ROUND #2 BIG WHEEL SPIN: ROUND #2 reduces the ten (10) BIG WHEEL SPIN Finalists down to one (1) finalist (the “Grand Prize Finalist”). The nine (9) eliminated BIG WHEEL SPIN Finalists may win a Challenge Prize between $5,000 and $50,000; and
- C. ROUND #3 PLINKO® (GRAND PRIZE FINALE): The Grand Prize Finalist plays for the chance to win a Challenge Prize from $12,500 up to the Grand Prize.
- 9. WINNER NOTIFICATION: If a player’s entry is selected in the Promotion drawing, the player will be contacted by phone, e-mail, and/or U.S. mail by the Illinois Lottery. In order to receive his or her prize, the player will be required to complete, sign, and return an Illinois Lottery Claim form with a copy of his/her personal identification to, the Illinois Lottery at the Illinois Lottery location included in the notice for verification. The claim form must be returned to the proper location prior to 4:30 p.m. CT on the twentieth business day after the drawing, or an alternate Prizewinner will be selected.
Any prize/prize notification returned as undeliverable will result in disqualification and an alternate Prizewinner will be selected. A selected Prizewinner who is contacted and fails to provide all information requested (e.g., age verification, address verification, signed publicity/liability release and affidavit as to identity, and social security number) in the time required will forfeit the prize, and an alternate Prizewinner will be selected. - 10. GENERAL PRIZE RESTRICTIONS: Only (1) one Prizewinner per household will be allowed. If due to a printing, production or other error more prizes are claimed than are intended to be awarded, the intended prize or prizes will be awarded in a random drawing from among all verified and validated entries. All prizes won by Prizewinners will be subject to the Illinois Lottery’s debt setoff procedures. The Prizewinners, designee(s), or guest(s) must have a valid credit card or shall be required to post cash deposit for incidentals to check into the hotel. The Prizewinner is solely responsible for the actions of the guest who accompanies the Prizewinner. If the Prizewinner’s guest is a minor, the Prizewinner must (a) be the parent or legal guardian of such guest, or (b) must present a notarized, written consent from the minor’s parent or legal guardian for the minor guest to accompany the Prizewinner on the Trip Prize trip. If air travel is required for the Prizewinner and guest, it is the responsibility of the Prizewinner and guest to comply with the Department of Homeland Security’s REAL ID Act to the extent such Act is applicable to Prizewinner’s air travel. If applicable, Prizewinner and guest shall be required to follow all health and safety protocols, including always wearing a facemask and following social distancing guidelines, as instructed by the event´s staff and volunteers and all federal, state, and local guidelines relating to COVID-19 or any pandemic.
At the time that a Prizewinner claims the Trip Prize, such Prizewinner shall be deemed to have taken ownership of the entire Trip Prize, and the full claimed value of the entire Trip Prize (including the value of the travel portion) shall be reported to the IRS. Accordingly, the Prizewinner may be responsible for any additional state or federal taxes resulting from the claimed Trip Prize, above and beyond those taxes withheld, reported and paid on the Prizewinner’s behalf by MDI to the appropriate agencies.
If, after claiming the Trip Prize, the Prizewinner does not wish to travel to the event, they may assign a proxy to travel and participate in the event on their behalf, provided that no travel has been previously booked; however, the original Prizewinner will be responsible for all taxes on the Trip Prize claimed. Prizes that may be won by the proxy shall be awarded to the Prizewinner (less applicable tax withholdings). If, after claiming the Trip Prize, the Prizewinner is traveling via air and fails to appear at the designated time and place of departure (excluding flight delays), then MDI will use reasonable efforts to reschedule the flight at the expense of the Prizewinner. If MDI is not able to reschedule the flight, then the Prizewinner will not participate in the trip portion of the Trip Prize (i.e., air travel, lodging and ground transfers) with the exception of the one thousand dollars ($1,000) cash portion of the Trip Prize, less any tax withholdings; however, the Sponsor or MDI will appoint a proxy to play the Challenge for the Prizewinner, and the Prizewinner shall receive any Challenge Prizes won by the proxy (less applicable tax withholdings and debt setoff).
If, after claiming the Trip Prize, the Prizewinner fails to check in to the hotel when he or she arrives in Las Vegas, Nevada, then MDI will use reasonable efforts to reschedule the reservation. If MDI is unable to reschedule the reservation, the balance of the trip portion of the Trip Prize shall be forfeited with the exception of the return air travel and one thousand dollars ($1,000) cash portion of the Trip Prize, less any tax withholdings; however, the Sponsor or MDI will appoint a proxy to play the Challenge for the Prizewinner, and the Prizewinner shall receive any Challenge Prizes won by the proxy (less applicable tax withholdings and debt setoff).
If, after claiming the Trip Prize, the Prizewinner fails to arrive for his or her scheduled participation in the Challenge, then the Prizewinner forfeits the right to personally participate in the Challenge; however, the Sponsor or MDI will appoint a proxy to play the Challenge for the Prizewinner, and the Prizewinner shall receive any Challenge Prizes won by the proxy (less applicable tax withholdings and debt setoff). In the event that a Prizewinner is determined to be unable to attend the trip after the trip has been booked, the balance of the Trip Prize shall be forfeited with the exception of the one thousand dollars ($1,000) spending money portion of the Trip Prize, less any tax withholdings; however, the Sponsor or MDI will appoint a proxy to play the Challenge for the Prizewinner, and the Prizewinner shall receive any Challenge Prizes won by the proxy (less applicable tax withholdings and debt setoff).
At the time that a Prizewinner claims the Trip Prize, such Prizewinner shall be deemed to have taken ownership of the entire Trip Prize, and the full claimed value of the entire Trip Prize (including the value of the travel portion) shall be reported to the IRS, regardless of whether the Prizewinner participates in all aspects of the Trip Prize. Accordingly, the Prizewinner may be responsible for any additional state or federal taxes resulting from the claimed Trip Prize, above and beyond those taxes withheld, reported and paid on the Prizewinner’s behalf by MDI to the appropriate agencies.
The minimum age requirement to play the Challenge is twenty-one (21) years per Nevada State Law. The Prizewinner or their proxy must be 21 years of age to be eligible to play the Challenge. If the Prizewinner is under the age of twenty-one (21) years old, he or she may pre-designate a proxy, or one will be chosen by the Sponsor or MDI, to play the Challenge on his or her behalf. The Prizewinner shall receive any Challenge Prizes won by the proxy on the Challenge (less applicable tax withholdings. In the event that the Prizewinner does not designate a proxy, and a proxy is necessary for Prizewinner to participate in the Challenge on his or her behalf, for any reason whatsoever, MDI or the Sponsor will appoint a proxy to play the Challenge on the Prizewinner’s behalf. The Prizewinner acknowledges that the proxy appointed by MDI or the Sponsor will have to make decisions on behalf of the Prizewinner and therefore, the Prizewinner delegates the power, authority or discretion to the proxy appointed by MDI or the Sponsor to make any such decisions on the Prizewinner’s behalf. The Prizewinner shall receive any Prize(s) won by the proxy in the Challenge (less applicable tax withholdings); The Prizewinner, designee, or guest must have a valid credit card or shall be required to post cash deposit for incidentals to check into the hotel. Participation in the Challenge may be subject to other local, state and federal laws, including the laws of the State of Nevada.
The total Challenge Prize won, less tax withholdings, during the Challenge by the Prizewinner or on the Prizewinner’s behalf will be mailed to the Prizewinner by MDI within twenty-one (21) business days after the Trip Prize concludes. MDI shall withhold from such Challenge Prizes the minimum required federal tax withholdings and any applicable state tax withholdings and shall deposit said withholdings on behalf of the Prizewinner to the appropriate agencies. The Prizewinner shall receive an IRS Tax Form W-2G from MDI and a copy shall be provided to the Sponsor. The Prizewinner may be responsible for any additional state or federal taxes resulting from the Challenge Prizes, above and beyond those taxes withheld, reported and paid on the Prizewinner’s behalf by MDI to the appropriate agencies. The Prizewinner may not choose to receive the cash equivalent of the trip portion of the Trip Prize.
All ROUNDS will be audited by an independent auditor (“Challenge Auditor”). Challenge Prizes are not considered won by a Prizewinner and are not payable unless and until the third-party underwriter of such Challenge Prizes (where applicable), SG’s Drawing Manager, and the independent Challenge Auditor certify that the Challenge has been conducted appropriately and in accordance, in all material respects, with the Challenge and security procedures, that a finalist has validly won the Challenge Prize pursuant to the Challenge and security procedures and is entitled to receive the Challenge Prize, and the third-party underwriter of such Challenge Prize (where applicable) has accepted the obligation to pay the Challenge Prize to the winning Contestant. - 11. GENERAL CONDITIONS AND RELEASE: The Promotion is subject to applicable laws and regulations. Participation in the Contest may be subject to other local, state, and federal laws, including the laws of the State of Nevada. By entering, each entrant (a) agrees at all times to defend, indemnify, release and hold harmless the State of Illinois, Illinois Lottery, FremantleMedia North America, Inc. and/or FremantleMedia Netherlands B.V., Sponsor, and Administrator (collectively, the “Promotion Entities”) and each of their respective owners, agents and representatives, parent companies, affiliates, subsidiaries, fulfillment agencies, legal advisors, advertising and promotion agencies, and any and all other companies associated with the Promotion and all of their respective officers, directors, employees, agents, and representatives (collectively, the “Released Parties”) from and against any and all claims, causes, costs, injuries, losses or damages of any kind that may occur, directly or indirectly, in whole or in part, arising out of the entrant’s participation in this Promotion or receipt or use of any prizes, including, but not limited to: (i) unauthorized human intervention in the Promotion; (ii) technical errors related to computers, servers, providers, or telephone or network lines; (iii) printing errors; (iv) lost, late, postage-due, misdirected, or undeliverable mail; (v) errors in the administration of the Promotion or the processing of entries, including but not limited to data entry errors resulting from or caused by the entering, keying or mis-keying of the required information by entrants; (vi) injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use of any prize; (vii) the unauthorized or illegal access to personally identifiable or sensitive information; or (viii) the acceptance, possession, use, or misuse of any prize or any travel or activity related to the receipt or use of any prize (b) if selected as the prizewinner, consents to the use by Sponsor, Administrator, and each of their respective designees of the prizewinner’s name, hometown, photograph, voice, or other likenesses and prize information for promotion, advertising, and marketing purposes in any media or format now known or hereafter devised, throughout the world, in perpetuity, without additional compensation, consideration, notification, or permission, unless prohibited by law, and upon request will provide written confirmation of such consent; and (c) acknowledges that relative to any prize, including but not limited to its quality or availability, none of the Promotion Entities or anyone else has either made, or is in any manner responsible or liable for, any warranty, representation, or guarantee, either expressed or implied, in fact or in law, including without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Each player entering the Promotion further agrees that in any cause of action, the Promotion Entities’ liability will be limited to the cost of the valid non-winning Illinois Lottery Eligible Game ticket used to enter the Promotion, and in no event shall the Promotion Entities be liable for attorney’s fees.
Each player entering the Promotion waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. Neither the Promotion Entities nor their agents and representatives, parent companies, affiliates, subsidiaries, advertising, promotion and fulfillment agencies and legal advisors are responsible for and will not be liable for: (a) late, lost, damaged, misdirected, incomplete, unintelligible, or postage due entries; (b) telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind; (c) failed, incomplete, or garbled or delayed computer transmissions; (d) any condition caused by events beyond the control of Promotion Entities that may cause the Promotion to be disrupted or corrupted; (e) any injuries, losses or damages of any kind arising in connection with or as a result of the Promotion, acceptance, possession or use of the name “COME ON DOWN Challenge Event” or “COME ON DOWN Second-Chance Promotion” or from participation in the Promotion; or (f) any printing or typographical error in any material associated with the Promotion. Each Prizewinner agrees that the Promotion Entities shall not be liable for injury, loss or damage of any kind resulting from participation in this Promotion or from acceptance or use of the prize awarded.
Any comments made by a Prizewinner in a social media forum containing material that is inappropriate, offensive, indecent, obscene, hateful, tortious, defamatory, slanderous, or libelous may disqualify the Prizewinner, at the sole discretion of the Illinois Lottery. By acceptance of the prize awarded, each Prizewinner agrees that the Illinois Lottery, Sponsor, and the Administrator may use their name, and/or likeness for purposes of advertising or trade without further compensation.
CAUTION: ANY ATTEMPT BY A PLAYER ENTERING THE PROMOTION OR ANY OTHER INDIVIDUAL TO DAMAGE ANY WEBSITE ASSOCIATED WITH THIS PROMOTION, TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE ILLINOIS LOTTERY WILL DISQUALIFY ANY SUCH ENTRANT, AND THE APPLICABLE PROMOTION ENTITIES AND THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT OR INDIVIDUAL(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
No failure to enforce any term of these Official Rules shall constitute a waiver of that provision. These Official Rules may be modified for clarification purposes without materially affecting the terms and conditions of the Promotion. Entrants not complying with all rules are subject to disqualification and an alternate winner will be selected from among all eligible, non-suspect entries received as of the time of such disqualification, as the Sponsor, Illinois Lottery or Administrator determine in their sole discretion. If for any reason the Promotion (or any portion thereof) is not capable of being executed as planned, or in the case of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of entrants, technical failures or any other causes, that in the opinion of Sponsor, Administrator or the Illinois Lottery, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion (or any portion thereof), Administrator, Sponsor, and the Illinois Lottery reserve the right in their sole discretion to disqualify any suspect entry or entrant and/or to cancel, terminate, modify or suspend the Promotion (or any portion thereof). In the event of any termination, cancellation, or suspension, notice thereof will be posted on the Illinois Lottery website.
FAILURE TO COMPLY WITH ANY OF THE OFFICIAL PROMOTION AND/OR CHALLENGE DETAILS, PROMOTION AND/OR CHALLENGE PROCEDURES, INDIVIDUAL CHALLENGE GUIDELINES, ANY OTHER GUIDELINES, OR CODES OF CONDUCT SET FORTH BY MDI, MAY RESULT IN A CONTESTANT’S DISQUALIFICATION AT MDI’S SOLE AND ABSOLUTE DISCRETION AND/OR THE REVOCATION OF ANY PRIZE WON DURING THE CHALLENGE. - 12. APPLICABLE LAWS: All entrants agree to comply with and abide by all applicable laws, including the Illinois Lottery Law (20 ILCS 1605/1 et seq.), administrative rules and regulations, instructions, conditions, and final decisions of the Illinois Lottery, and all procedures established by the Illinois Lottery, Sponsor, and the Administrator for the Promotion. In the event of a conflict between these Official Rules and any summary, representation, or other restatement of rules appearing in any advertisement, point of sale material, tickets or other media, these Official Rules shall govern. In the case of a conflict or contradiction between or among the Illinois Lottery Law, Lottery administrative rules (11 Ill. Adm. Code Sections 1700 and 1770), and the Official Rules governing this Promotion, the Illinois Lottery Law and administrative rules shall control. The Illinois Lottery does not waive sovereign immunity rights provided under law and nothing in these Official Rules shall be interpreted to constitute a waiver of the Illinois Lottery’s sovereign immunity rights.

DISPUTE RESOLUTION: Except where prohibited by law, by entering, Promotion entrants agree that in the event of a dispute concerning the construction, validity, interpretation, or enforceability of these Official Rules, the determination of the Sponsor shall be final and binding. Any entrant who disputes a final decision of the Sponsor may seek review before an administrative law judge pursuant to Section 7.3 of the Illinois Lottery Law. In accordance with the Illinois Lottery’s hearing rules (11 Ill. Admin. Code Part 1700), the Director will review the recommendation of the administrative law judge and, if applicable, the Board, and issue a final decision regarding the dispute. Any party adversely affected by a final decision or order of the Director may obtain judicial review as provided by the Illinois Lottery’s hearing rules and Administrative Review Law (735 ILCS 5/Article III). All issues and questions concerning the rights and obligations of participant(s) in relation to Sponsor, Administrator, and their agents shall be governed by and construed exclusively in accordance with the laws of the State of Illinois without giving effect to any principles of conflicts of law of any jurisdiction. Entrant agrees that any such action at law or in equity shall be filed only in the state or federal courts located in Chicago, Illinois, and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. EXCEPT WHERE PROHIBITED BY LAW, BY PARTICIPATING IN THIS PROMOTION, EACH ENTRANT AGREES THAT: (A) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS PROMOTION, OR AWARDING OF THE PRIZES, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; AND (B) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH PARTICIPATING IN THIS PROMOTION BUT IN NO EVENT ATTORNEYS' FEES; AND (C) UNDER NO CIRCUMSTANCES WILL ANY PARTICIPANT BE PERMITTED TO OBTAIN AWARDS FOR AND HEREBY WAIVES ALL RIGHTS TO CLAIM PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL, MULTIPLIED OR OTHERWISE INCREASED DAMAGES; AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES.
